THE TRUTH BEHIND CLEVERBUY SCAM

It’s a privilege to work in a prestige company, a company that can provide security and welfare to its people. Working in CleverBuy Inc. or CleverBuy Marketing Inc., or simply CleverBuy is just a one company managed and run by German people headed by our CEO CHRISTIAN GORG BAYER who is also the CEO of J2 Discount Travel and Tours and the CEO of Webix Business Solutions Inc., is simply a dream come true for me. It has a good intention and good objectives, good salary which is basically the bottom line why I am working. The goals are very clear. CleverBuy provides me a good office, generous boss, friendly officemates, challenging job that’s what I after in this company. DO I HAVE TO REJECT THIS KIND OF JOB?

Today if I have to define CleverBuy, what’s on mind is a FIRST CLASS ONLINE SCAM and I’m sure that’s also the definition of our customers who were victims of this Group Buying online site. Millions of pesos are coming in to this group buying site, 22 Million for the month of August 2011, 11 Million for the month of September 2011, 7 Million for the month of October, 15 million for the month November, 7 million for the month of December, 16 Million for the month of January, 12 million for the month February, 10 million for the month of March, unfortunately I was not able to keep a record for the month of April and May. Based on the figures I have it looks good, definitely a good number for the business but the biggest question is…WHERE ARE THOSE MONEY?

Running this kind of business is not that easy, we need to coordinate with partner merchants to give us a good deal or a good package which will run on the website of CleverBuy. One of our partner merchant is J2 Discount Travel and Tours, owned by Christian Gorg Bayer. They provide us package deals like Coron tour package, Boracay tour package, Puerto princesa tour package and Bohol tour package in a very low price, no, in a negative price. The costing of 1 package will reach up to 15,000 pesos including the airfare and accommodation but CleverBuy is selling it for only 9,900 pesos. You may ask me why CleverBuy is selling this kind of service in a negative price. According to Mr. Bayer this is only to generate more income, to have an enticing look and to have instant cash. DOES IT SOUND LIKE A BUSINESS?

Thousands of customers purchased from CleverBuy. Well, Mr. Bayer may be right, there’s instant cash from this kind of business, million of cash in an instant. J2 was able to send customers to their preferred destinations, they even rented private planes, chartered flights just to accommodate our customers’ needs and we are able to generate funds and we live in a luxurious lifestyle. High budget events, prestige launching, expensive marketing strategies, online advertisement from different online platforms, high priced online games, facebook advertisement which reaches up to 45,000 per month…not in pesos but in EUROS for facebook advertisement alone, new office with the rental of 400,000+ pesos in a month and sad to say we are not able to use the new office since January until today but we are paying the rental of the said office. CleverBuy expanded in other countries like Thailand and Indonesia; hiring new people in these countries, paying too high for these people cause they were pirated in other group buying sites. These are some of the activities of CleverBuy and all these activities were approved by our General Manager David Staudigel and our CEO Christian Bayer. IF YOU ARE A GOOD BUSINESSMAN, WILL YOU SPEND TOO MUCH FOR ALL THESE THINGS?

The recent year, based on the figures given above it seems like CleverBuy is slowly taking it slope down. The first quarter of 2012 shows that CleverBuy is not doing well. Same with J2 discount Travel and Tours, they are not doing well due to a lot of complaints against them, they are not answering phone calls, they are not replying to customers’ emails primarily because CleverBuy is not giving them anymore enough funds for the redeeming customers. Many of our customers who purchased from the previous year want to redeem their voucher from J2 Discount Travel and Tours this summer. They want to grab the opportunity of enjoying vacation this summer using the services offered by J2 Discount Travel and Tour in a very low price. CleverBuy fund starts to deplete, chaos starts to rise from J2 and another travel agency who offers the same problem to our customers, the Trip Toe Travel and Tours. CleverBuy paid the total amount of more or less 5 million pesos to Trip Toe Travel and Tours for the service that is supposed to be for our customers; unfortunately they were not able to provide the services they offer. DO YOU THINK THIS IS THE ROOT OF THE PROBLEM?

First week of May 2012 Mr. Bayer wants to shut down J2 Discount Travel and Tours because of the never ending complaints against them and the never ending bookings, new bookings, new reservation and the never ending liabilities to different hotels and tour operators. Costumers are running to CleverBuy because they can’t reach J2 anymore, it’s already closed and most of the staffs resigned from their positions. CleverBuy management wants to take the responsibility from J2, as manager we have foreseen the future that it will cause more chaos if we will not take charge of what’s happening with J2 because we from CleverBuy has the responsibility and liability for our customers. CleverBuy staffs were assigned to entertain customers of J2, handle new bookings, make new reservation, coordinating with some of the customers, updating customers with the previous commitments made by J2. We took the responsibility from J2 of hoping that everything will be okay as promised by the top management that they will do their best to save the company; because of that promise that they always be there behind our back we are able to get back the confidence of our customers. We made promises to our customers and it’s not our intention to lie to them, it’s not our intention to give them false hope because we are still holding on to that promise that everything will be okay, that they will provide us a new fund, that they will support us. WHO WILL BE RESPONSIBLE THEN IF WE DID NOT TAKE THE RESPONSIBILITY OF J2?

Taking charge of the new responsibilities, we forget our previous job responsibilities, our very own job. The fund of CleverBuy is completely depleted because we are paying not only our merchants, not only our own employees, not only the company expenses but the company expenses of Webix Business Solutions Inc., the company expenses of J2 Discount Travel and Tours and CleverBuy is also sending fund to Intermax AG (company owned and managed by Christian Bayer in Czech Republic that provides adult dating sites in European countries) amounting to 25,000 EUROS per month. All these expenses came from the payments made by our customers here in the Philippines. HOW CAN THEY BE A HELP TO CLEVERBUY PHILIPPINES IF THESE GERMAN PEOPLE ARE TAKING MONEY FROM US INSTEAD OF SENDING NEW FUND FOR CLEVERBUY?

“The boat is sinking!” Those are the serious words we got from Mr. Edgardo S. Garcia who happened to be the President and the dummy owner of all these companies created by Christian Bayer. He is simply manipulated by these German people to run the business in the country. Because of that serious joke from Mr. Garcia, our Project Manager in the persona of Mr. Christoffer Aranez who is supposed to be responsible for the entire operation of CleverBuy quits in his position in the middle of crisis in the company. Managers were left behind together with the rank and file employees. We want the company to survive, we are still holding on because we are afraid that we might be losing our job. We are holding on to the promise they made, new fund is coming, new investor is coming, we can generate more funds but we have realized that no one is coming to save us, no more funds for CleverBuy, no more salary for the employees, no commissions, pending and filing up liabilities, no more payments for the merchants, refunds are getting bigger and bigger it’s because some of our partner merchants are not accepting the voucher of CleverBuy anymore because we have not paid them. Irate customers coming to the office complaining of the services of our partner merchants, complaining of J2 services, complaining the process of the refunds, merchants are coming to the offices asking for the payment for the services they have provided to our customers but our employees and staffs absorbed all those things from our customers and merchants despite of the harassment, the threat and the verbal abuse, we understand the situation it’s because we can feel how difficult it is to spend a hundred thousand of pesos for nothing. It’s not our job to face these people; it was just assign to us because they have seen the potential from us to work well and to pacify these people. CAN YOU BLAME US IF WHAT WE WANTED IS SIMPLY TO HOLD ON WITH THE SITUATION?

Despite of what we have experience from our customers and from our partner merchants we are not losing our hope that our employer will help us. We remain calm; we still keep the diplomacy between our customers and CleverBuy. The most painful thing is that we keep our customers to believe in us despite the fact that something might not happen anymore. We have built friendship from some of them, some of them were so good to us, they have entrusted us the fate of their vouchers, and some of them consider us as heroes from their bad experience with J2 and Trip Toe. No matter how hard we try to push through the promises we made but we are just simply an ordinary employees, helpless and are just contented of what we got from our employer. We have not fulfilled our promises to them and that’s the heaviest burden we are carrying right now, the guilt inside us. WILL YOU CURSE US BECAUSE WE HAVE NOT FULFILLED OUR PROMISES DESPITE OF ALL THE EFFORTS WE HAVE DONE?

First week of June 2012, our CEO Christian Bayer arrived here in the Philippines. We are hoping that he will bring good news for all of us. We are hoping that he will solve all these problems but our hopes shattered when he wants to declare bankruptcy for CleverBuy, for J2 and for Webix Business Solutions Inc. This is not what we are aiming for. We have our own families who depend on us. We gave our lives for this company, we risk our names and we gamble our future in CleverBuy and in just one snap he disowned us. He has the guts to say that he is NOT the owner of CleverBuy. He has the guts to tell us all that we will not expect anything from them anymore. Even our salary, we can’t have it anymore. Customers are cursing us, threatening us, throwing hurtful words for us, we have a boss who disowned us, did not support us anymore, partner merchants who are filing case against us, pending complaints at DTI and NBI against us. WHO ARE WE AND WHERE ARE WE NOW?

As of this writing Mr. Bayer is preparing to build for another company. No more CleverBuy, no more J2 Discount Travel and Tours and no more Webix Business Solutions Inc. A new company is coming out under his power, unknown yet but this company will still provide services for adult dating sites, pornographic sites for European countries. He will be using the talent and skills of Filipino people but he will not give security for them just like he did for us.

        Hello Michelle, I’m very thankful that somehow a satisfied customer of CleverBuy came out to the open for a positive comment. Cleverbuy is NOT connected to any group buying site in the Philippines. We might have some employees who are recently working with other group buying site but it’s definitely a different management!         By the way, just an update with the case of CleverBuy…a formal case was submitted to the court. CleverBuy Management, Directors, Stockholders will be summoned soon for court examination. Justice will be rolling soon to all the victims of CleverBuy. Good luck to all of us!

    So that’s probably the reason why i had problems with what i availed from clever buy for 3d2n stay in puerto galera. it was from j2 travels as well. i got it around third week of january and never had a chance to use it. i tried to call several times and nothing happened until now. voucher will expire this june. I wanted to have my money back but based on your story, looks like im not gonna have it back as much as i want to. I just wish that who ever the person is behind this will suffer..

My apology to all the victims of cleverbuy, from the merchants, to the customers of cleverbuy and even to my fellow employees. I am expressing here what is truth coz we are also a victims here. I’m sad for my fellow employees coz mostly of our merchants are hunting for us, our customers are hunting for us, we were disowned by our own boss. Thank you for understanding us. as of this writing we are filing some complaints to the DOLE and we will seek assistance from NBI and we will a case against our own company. To my fellow employees I am encouraging you to come out and let us help one another to fight what is right not only for us but also to our customers and merchants!

        I just read your message. First of all, wala po akong idea na tatakbo po agad cya palabas nang bansa natin. Nung June 5, accidentally ko lang cya nakita sa condo na tinutuluyan nang mga staff kung saan dun din po ako nakatigil. Katatapos lang nang meeting nila (Christian Bayer, Edgardo Garcia at David Staudigel). Tinanong ko cya regarding kung ano ang plano nya sa mga payables sa hotels at tour operators at ito lang sinagot nya sakin …”We are currently discussing it and the lawyers knows what to do” at sabay talikod. Wala na cyang binangit pa kung ano yung solution nila tungkol dun sa tanong ko.

        After that, June 8 (Second Hearing at NBI) napanood ko na lang sa news na nakalabas na ito nang bansa. Di ko po alam kung anong gagawin sa mga naiwan nyang dapat bayaran.

        First week of April pa lang tumatakbo na kami sa office ni Edgardo Garcia para humingi nang funds para sa booking nang J2 Discount Travel, pero wala pong maibigay silang funds. Hanggang nang dumating itong si David Staudigel nung May pero hindi rin nagkaroon nang solution yung pagpunta ni David Staudigel, bagkus ang minungkahi pa nga nya sa mga managers na mag-“UP ” nang deals nang J2 to get the revenue para magamit sa mga nag-rerefund and sa booking nang J2 Discount pero TINUTULAN lahat ito nang mga managers at naging solution nila ay ibenta yung company sa investor at iyon ang naging papel niya dito. Pero I think yung paghahanap nya nang sinasabi nyang investor ay front nya lang para masabing may ginagawa cyang paraan at di cya kulitin nang mga managers.

        Regarding sa Financial status, only Christian Bayer and Edgardo Garcia knows the standing of the company. Walang nakaka-alam sa mga board kung san-saan napupunta ang revenue nang CLEVERBUY.

        Pacencya na po sa nangyari kahit kami po na mga empleyado nya ang naging biktima nang kanyang kalokohan.

      i too have a pending request for a refund. i requested this way before CleverBuy shut down, I had a funny feeling that something was not going right. I have emailed several times to f/up the refund, to no avail. Pls pressure mozcom to process the refunds of customers’ hard-earned money. Good luck….

    Hi. I’m one of the merchants and we were not paid since last week of April. All our latest deals ran this May ( 4 deals this May) and we were not able to get payment for all the vouchers we have serviced. Please update us and inform us if we can still get payment for all of these redeemed vouchers. According to Mozcom, all payments made by voucher holders this month of May has not been remitted to Cleverbuy.I hope you can also help the merchants because Cleverbuy is liable for all these redeemed vouchers that we have serviced.

    i have 2 voucher po ako going to coron palawan . naka schedule na sa september. ang punta nmin kinuha na rin ng j2 travel yung voucher ko. kya lang close na ang cb diko na mabuksan ang account ko doon andoon pa naman ang mga copy ko. pat sai email ko diko na rin mabuksan yung voucher na sent sa akin ng cb.i hope na maayos na rin ito managot ang dapat managot. thanks

    I am a victim as well, I purchased the bellarocca voucher and it really pains me since I really was looking forward to it as I worked so hard for it. This was the first trip I saved up for thru hard earned money and now I have nothing to look forward to. If i cant get my money back, thats a huge loss but I do hope they place those people responsible for all this crap going on behind bars.

    Thank you po sa lahat ng support. All of us are victims of this CleverBuy. Right now we are advised by our lawyer not to mention so many things in here kasi on going na ang investigation ng NBI. Sobrang laki ng possibility na medyo matagalan pa tong process na to since the owner of CleverBuy is not in the country anymore, they need to coordinate with the Interpol para di na makapasok sa Pilipinas or mahuli na siya dun sa labas ng bansa.

    Humihingi po ako ng paumanhin sa mga partner merchants ng CleverBuy di rin po namin alam sa ngayon paano namin mabayaran kayo since kami mismo di na kami ina acknowledge ng boss namin. Wala na kami access sa system namin.

    Sa lahat po ng customers po ng CleverBuy humihingi po kami ng pasensya pero as of now umuusad na po ng konti yung case na naifile against CleverBuy. Medyo matagalan pa po siguro pero atleast umuusad na. Yung refund from Mozcom inaayos na rin para sa May 2012 na mga transactions.

    Sa mga empleyado ng CleverBuy, pasensya na kung bigla akong nawala for the past week at di ko nasagot mga phone calls at texts ninyo. Umuwi po ako ng probinsya, siguro sa sobrang stress medyo di na manganda yung takbo ng health ko rin. Atleast dito sa probinsya may magbabantay sa akin, babalik po ako ulit kasi di pa tapos ang pinaglalaban natin.

    Humihingi po kami ng pag unawa sa inyong lahat. Naging biktima po tayo ng CleverBuy at ngayon sabay sabay po nating hanapin ang hustisya para sa lahat! Maraming salamat po!

  29. Jhae, I tried to contact Mr. Garcia to ask for updates but he’s now unreachable. I texted his lawyer and he said that he couldn’t contact Mr. Garcia anymore. What’s going on? I became sympathetic with Mr Garcia during the NBI meeting but now I’m not so sure how trustworthy he is. He promised to keep in touch but is now unavailable. Is he in hiding? Is he still in the Philippines? Why can’t his own attorney contact him?

    If you are as much of a victim as we are, I hope you’re putting your trust on the right people.

    @Man, as of now di namin alam yung solution. As we have mentioned here, we were abandoned by our own employer. Wala kaming mga contacts na ngayon sa mga big boss namin kasi di na sila nagrereply sa mga emails at phone calls namin, even Mr. Garcia di namin makontak sa ngayon. As of now we are holding on to our faith and to our co-employees who been fighting on this from the very start. Most of us walang pera and we don’t even know where to get to pay for lawyers. Kaming mga empleyado may mga complaints na sa NBI sa ngayon at isa isa na kaming pinapatawag kaya di na ako masyado magdedetalye dito. On going na po yung kaso!

    @RR, for the month of April na transactions naeremit na po ng Mozcom yun sa CleverBuy. As of now yung mga transactions lang ng May yung pinaprocess nila.

    @unsugarcoatedreviews.com, I’m putting my trust right now to right people. I am not trusting to any one of them since the issue started. Right now, I received a subpoena from the NBI and as advised to us, I can’t give the whole details in here since the case is now moving forward.

    @Anonymous, Transactions made last January 2012 naeremit na lahat yun sa CleverBuy. Yes, nag issue sila ng promissory note na magbibigay sila ng refund on June 25, 2012 but sad to say na wala ng pumasok na pera from these German people para sa Webix Business Solutions Inc. at para sa CleverBuy. Mr. Garcia promised to give you back the refun dahil sa pinaasa din siya na may papasok na pera.

    @xFactor, I know how it feels like to be betrayed and disowned by your own company. I was even confined in the hospital for about a week because of stress. Hyperventilate, high blood pressure and I was even bleeding because of all these things. Let’s just hope and pray that justice will prevail for all of us. From the customers, to our merchants and to all of us.

    @Iya Kida, wala na pong nagrereport sa Marvin Plaza sa ngayon. Wala na pong tao dun, wala ng support na natatanggap yung Webix at ang CleverBuy from Christian Bayer.

    @Ken Dizaon, yung Dragonpay account is an account owned by Payeasy / Mozcom. It’s the same account na ginagamit ng ibang group buying site. Di po pwedeng ipahold yung account na yun kasi hindi naman yun pagmamay ari ng CleverBuy.

    OMG, I bought 4 vouchers to Palawan almost 20k last December thru HSBC credit card, ? Is there any little chance to have a refund hu hu hu….What are the chances of getting a refund after all the hearings and investigations of our NBI?

    Here’s to everyone. Those who paid thru credit card, you can request for a reversal of charges provided you do the ff: write a letter of dispute, attach all supporting docs such as the vouchers you bought and confirmation email from Mozcom. For over the counter payment thru any accredited banks, go to the bank and ask for their dispute form. Fill it up. Attach also all
    documents you may have that is vouchers, confirmation email from mozcom, deposit slip. It may take some time, around 2 – 3 months. Lets just hope for the best. Mozcom has already contacted me and asking for supporting docs since my credit card company already issued a dispute letter to them. Goodluck to us all.

      Another company to be wary of – Mozcom. Another lesson learned from this disaster – stop availing the services of mozcom when paying for online transactions. The way they handled the problem sucks. Spare yourself the heartache and the stress. They do not have good customer service.

        The thing is this is not their problem in the first place. If you didn’t read the agreement carefully, it’s your problem, not theirs. They started helping people a few weeks back but ofcourse when people start talking, everyone follows. Unless you’re expecting Mozcom to accommodate everyone for a problem that’s not theirs in the first place then you’re just finding something else to point the finger at…think before you speak. put yourself in their shoes.

    To b, I never said that it is Mozcom’s problem or whoevers. What I said is the way they handled the problem. Their customer service really did suck and that is a fact. Think before you speak. Put yourself in the shoes of cleverbuy victims.

    I’ve been out of the country since May 11. I got my check from Cleverbuy on the day of my flight. I asked my friend to deposit it on May 18 bec that was the date that their staff told me to deposit it. Metrobank returned it bec according to them it’s a closed account already. I’ve read here about the dispute form so I can refund my money? Is it right, that I can use it to refund my money? Or is there other way on how to do it? It feels really bad thinking that ur money was taken just like that by a company or a person. I’m going back to Philippines on March and I’m planning to go to their office but I’ve read here that it’s closed already. Where can we complain? Where can we follow-up for our money?
